Persuasive Litigation Contributes to Success for Client

 

Background

Recently, litigators in the Insurance Practice group at Chaffe McCall secured a favorable outcome at trial on behalf of an insurer client in the Fifteenth Judicial District Court for the Parish of Lafayette.  Chaffe McCall litigators presented prevailing arguments and were dismissed on a directed verdict in favor of the client with regard to the application of a policy exclusion. While the liability case proceeded to a final adjudication by the jury, Chaffe McCall attorneys were able to resolve the coverage issue at the close of Plaintiffs’ case, and the client insurer was dismissed from the suit with prejudice.

Chaffe McCall’s Role

Chaffe McCall was retained to defend an insurance company, named as a Direct Action defendant, as to coverage.  While the court previously declined to grant a pre-trial Motion for Summary Judgment on the application of a policy exclusion based on an issue of fact, the Chaffe team successfully resolved the issue by effective cross-examination and a Motion in Limine that limited Plaintiffs’ expert to the opinions expressed in his report. Having remedied the factual impediment that previously prevented judgment as a matter of law in the client’s favor, our team requested and later granted a directed verdict at the close of Plaintiffs’ case in chief.
