Charles D. Marshall

Charles “Tuck” Marshall is a partner in the New Orleans office and serves as the firm’s hiring partner. He has tried numerous civil and criminal cases in state and federal courts representing both plaintiffs and defendants.
By focusing on the client’s definition of success, Tuck has substantial experience handling trials, arbitrations, mediations, and mandamus and injunction proceedings. His practice areas include:

Tuck combines his broad background in litigation with his in-depth knowledge of the insurance industry to help clients resolve tough insurance issues ranging from “direct action” matters involving property damage, personal injury, and bad faith, to defending claims against insurance brokers and agents. He also acts as a legal adviser to a number of companies across industries and frequently represents business partners in shareholder disputes.
Tuck has defended numerous clients facing felony criminal charges in state and federal court. He also has extensive experience handling white-collar cases involving charges of healthcare fraud, obstruction of justice, tax fraud, illegal kickbacks, and wire fraud.
Tuck receives criminal case appointments as an active member of the CJA Panel of attorneys in the Eastern District of Louisiana. In 2009, in connection with his work on a post-conviction death penalty case, Marshall received the prestigious “Camille Gravel Award” from the Federal Bar Association that is given annually to attorneys who have done substantial pro bono work.
Tuck graduated from the University of the South Sewanee with a Bachelor of Arts degree in English Literature in 1995. In 2001, Marshall received a Juris Doctorate degree from Louisiana State University Law School, where he was a member of the Law Review, the Order of the Coif, and received the Kantrow, Spaht, Weaver & Blitzer Annual Scholarship.

- In the Matter of the arbitration between: Seawinds Funeral Home, LLC and Baldwin-Fairchild Funeral Homes, Inc. (AAA #33 181 Y 00185 09) (After five day arbitration hearing in Orlando, obtained a defense judgment awarding zero damages to the plaintiff in connection with the sale of a funeral home which included allegedly undisclosed pre-need contracts).
- State v. Neville, Orleans Crim. Court, No. 520842 (Judge Trial) (Judgment of Acquittal on felony charges of failing to pay casino markers in excess of $300,000).
- U.S. v. Mix, EDLA No. 12-cr-171 (Jury Trial) (defended BP engineer charged with two counts of felony obstruction of justice charges. After a jury acquitted the defendant of one count, the Government agreed to drop all felony charges).
- Bolton v. Sea-Mar, 34th JDC St. Bernard Parish, No. 102-157 (Judge Trial). Defended lumber company in negligence claim regarding an overturned truck. Defense verdict obtained after bench trial. Judgment affirmed by 4th Cir. Ct. of Appeal.
- Allied v. Richard Edgecomb and Marsh USA Inc. (Texas), 19th JDC, No. 485309 (Judge Trial). Represented defendants and obtained defense verdict on all claims including unfair trade practices, breach of contract and tortious interference. Judgment affirmed by 1st Cir. Ct. of Appeal.
- Dockloaders v. ILA, CDC no. 08-12487 (Judge Trial) (Represented local union in petitory action involving disputed title to immovable property).
