Tax Credit

Chaffe McCall’s Tax Credit Practice is composed of attorneys with experience assisting investors, lenders, developers and businesses in effectively using tax credit incentives to reach their commercial goals.

Depending on client need, the resolutions our professionals provide range from the basic to the complex. Many of our tax professionals are admitted to practice before state and local tax authorities as well as the U.S. Tax Court. Our tax lawyers have supplemented their law degrees with a Master of Laws degree in taxation or as Certified Public Accountant designations.

Our specialized experience includes:

Federal & State Tax Incentives

Chaffe McCall has represented clients in transactions that involve various federal and state tax incentives, including Louisiana motion picture tax credits, historic rehabilitation tax credits, and new markets tax credits. Chaffe McCall’s Tax Credit Practice attorneys have a solid reputation on providing the necessary guidance and analysis needed to fully utilize these incentives.

Historic Rehabilitation Tax Credit Transactions

Our attorneys have experience working on transactions involving federal and state historic rehabilitation tax credits, including initial structuring of entities, negotiations of operating agreements with tax credits investors as well as reviewing all financial components of the project’s projections. We have assisted with every aspect of a historic tax credit transaction from qualifying a project with SHPO (state historic preservation office) to successful exit strategies post recapture period. In addition, Chaffe McCall has experience applying for, receiving, and monetizing state historic rehabilitation tax credits.

Louisiana Motion Picture Tax Credits

Our attorneys have been involved with the Louisiana Motion Picture Tax Credits since 2004. We assist numerous national and international production companies as they navigate the incentive process from pre-production to monetization of their tax credits. Our attorneys stay abreast of the ever-changing rules and regulations to make sure our clients have the most up-to-date information at their fingertips. We also assist with parish incentives that are available for motion picture production companies.

New Markets Tax Credit Transactions

Chaffe McCall has experience structuring transactions involving federal and state new markets tax credits. Our attorneys have represented leverage lenders, community development entities and qualified active low income community business. We are familiar with the complex structuring of new market tax credit projects and enjoy exceeding our clients’ expectations at closing. After the compliance period has ended, our clients rely on the Chaffe McCall Tax Credit Practice attorneys to assist in “unwinding” these complex transactions.
